1. Agreement to Terms

By accessing and using ServerBay ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services. ServerBay is a marketplace connecting buyers and sellers of Virtual Private Servers (VPS) and dedicated servers.

2. Marketplace Role

ServerBay is a directory and listing platform only. We do not provide hosting services, we do not handle payments, and we are not a party to any transaction between users. You trade at your own risk. We are not responsible for the quality, safety, legality, or delivery of any servers listed on the Platform.

3. User Obligations

• Users must be at least 18 years old or the age of majority in their jurisdiction.
• Users must provide accurate, current, and complete information during registration and listing creation.
• Users must provide their REAL NAME.
• Sellers must have the legal right to sell or lease the infrastructure they list.
• Users are responsible for maintaining the security of their account credentials.
• Sellers should mark their product as sold after it has been sold. Repeated failing of this will result into ban.

4. Prohibited Content & Conduct

You agree not to use the Platform to:

• Post fraudulent listings or misleading information.
• List servers intended for illegal activities (e.g., DDoS attacks, hosting illegal content).
• Harass, abuse, or harm other users.
• Attempt to circumvent the Platform's security or integrity.
• Inapprorate profile pictures.

5. Fees and Payments

ServerBay currently provides listing services. Any fees for premium features will be clearly communicated. Since transactions between buyers and sellers occur off-platform, ServerBay is not responsible for refunds, disputes, or payment failures.

6. Payment of Transfer Fees

The sellers are responsible for paying the transfer fees wherever applicable. It should be included in the asking price.

7. Limitation of Liability

To the maximum extent permitted by law, ServerBay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

8. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any significant changes by posting the updated terms on the Platform. Your continued use of ServerBay after such changes constitutes your acceptance of the new terms.
